Terms of Service

Producer.center is a web service for small businesses that helps companies manage their own social-media accounts themselves: analytics for their own accounts, ideas, topics and formats, scripts, strategy, and the preparation and publishing of their own content to their connected accounts. Each user connects and manages only their own accounts. The Service may use artificial-intelligence tools to generate and analyze content.

What the Service does

• provides a tool for producing content and for analytics of accounts that the user owns or is authorised by the owner to manage;
• processes data from connected accounts solely through the official access (API) of the respective platforms and only within the permissions granted by the user;
• helps with text: the AI assistant prepares script drafts, structure and planning, and generates a cover image for the user's video from a text description;
• compiles information about other authors in the niche exclusively from public posts.

What the Service does not do

• does not provide services to increase followers, likes, views or any other engagement, and does not guarantee any reach or publication results;
• does not provide access to other people's accounts or to the private statistics of their owners;
• does not create synthetic images, video, faces or voices of real people;
• does not provide consulting services by human specialists: expert and editorial checks are automated features of the Service performed by algorithms and AI.

• you must be at least 18 years old and authorized to act on behalf of the company you represent;
• you are responsible for the accuracy of your registration details and for keeping your credentials secure;
• you are responsible for activity under your account and for the members you add and their roles.

The Service is not provided to persons located in territories subject to sanctions restrictions, nor to persons acting on their behalf. Registration and payment from these jurisdictions are rejected.

Territories where the Service is fully closed

• the Democratic People's Republic of Korea (North Korea);
• the Islamic Republic of Iran;
• the Republic of Cuba;
• the Syrian Arab Republic;
• the Autonomous Republic of Crimea and the city of Sevastopol;
• the occupied parts of the Donetsk, Luhansk, Zaporizhzhia and Kherson regions of Ukraine.

Restriction on the type of payer

For Russia and Belarus the contract is concluded with private individuals only: paying as a company or a sole trader is not available, and the payer type in the billing profile is limited to “A private person”.

By registering and paying for access you confirm that you are not located in the territories listed above, do not act on behalf of persons located there, and are not subject to sanctions of the EU, the United States or the United Kingdom. If we discover a breach, we may terminate access immediately and refuse to provide the service; amounts paid for the part of the service not rendered are refunded as described in the Refund Policy.

Plans, limits and payment terms are published on the pricing page (https://producer.center/pricing). A free plan is available. Paid subscriptions are charged in euro by bank card through the Stripe payment platform — monthly or yearly, renewing automatically until cancelled. Listed prices exclude VAT; the applicable tax (IVA/VAT) is calculated on the payment page according to the buyer's country and status. You can cancel renewal at any time in the Service or by writing to info@producer.center: no charges are made after cancellation, and access continues until the end of the paid period. We give at least 30 days' notice by email of a price increase or any other material change to these Terms; if the new terms do not suit you, you may cancel the subscription before they take effect.

When using the Service, you agree not to:

• violate the law, third-party rights, or the rules of connected platforms (Meta, YouTube/Google, TikTok);
• publish unlawful, misleading, or abusive content, or content that infringes others' rights;
• attempt unauthorized access, disrupt the Service, circumvent restrictions or limits, or scrape beyond what the APIs permit;
• use the Service to send spam or otherwise abuse it.

By connecting Instagram/Facebook, YouTube, or TikTok accounts, you authorize the Service to access the relevant APIs within the granted permissions and to act on your behalf. You connect only accounts that you own, and you use the Service to manage your own accounts. Use of these platforms is governed by their own terms. The Service is not affiliated with or endorsed by Meta, Google/YouTube, or TikTok.

Features that work with YouTube use YouTube API Services. By connecting a YouTube channel and using these features you agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms); Google's handling of data is governed by the Google Privacy Policy (https://policies.google.com/privacy). You can revoke the Service's access to your Google account at any time at https://security.google.com/settings/security/permissions. Exactly which YouTube data we receive, why, where and how long we store it, and how to delete it is described in our Privacy Policy and on the Data Deletion page.

• you retain rights to your content and data uploaded or created in the Service, and grant us a limited license to process them solely to operate the Service;
• AI-generated content is provided “as is”; you must review it before use and publication and are responsible for the material you publish;
• you are responsible for holding the rights to any material you publish through the Service.

The Service itself, its software, design, and trademarks belong to the operator and are protected by law. These Terms grant you no rights to them other than the right to use the Service in accordance with these Terms.

Processing of personal data is described in the Privacy Policy, which forms an integral part of these Terms.

The Service is provided “as is” and “as available”, without express or implied warranties. We do not guarantee uninterrupted or error-free operation or any specific results, including reach or performance metrics of publications.

To the maximum extent permitted by law, the operator is not liable for indirect, incidental, or consequential damages, lost profits, or data loss arising from use of the Service. Total liability is limited to the amount you paid for the Service in the preceding 12 months (or zero if the Service was provided free of charge).

You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms or legal requirements. After termination we process your data in accordance with the Privacy Policy.

We may update these Terms. We will notify you of material changes in the Service or by email. Continued use after changes take effect constitutes acceptance.

These Terms are governed by the laws of Spain. If you are a consumer, this does not deprive you of the protection of the mandatory rules of the country of your habitual residence in the EU (Article 6 of Regulation (EC) No 593/2008, “Rome I”), and you may bring proceedings before the courts of your place of residence. Disputes with buyers who are not consumers are heard by the competent courts at the provider's location. Any dispute is resolved faster before court by writing to info@producer.center — we reply within 3 business days. We are not bound by, and do not participate in, any alternative dispute-resolution scheme for consumers; you remain free to contact the consumer-protection authority of your country of residence, and in Spain the consumer authorities of the relevant autonomous community.
